The proposed new phytosanitary legislation will replace the current Agricultural Pests Act, 1983 (Act No. 36 of 1983) (APA) and its associated Regulations when promulgated after completion of the required national processes. This will enable the South African Government to enhace the management of pest risks associated with plants and plant products, including risks that arise from the entry into as well as establishment and spread of quarantine pests in South Africa. It is also expected to provide greater transparency and accountability, promoting good governance and procedural fairness. The proposed legislation is designed to ensure broader, yet more efficient provisions to manage phytosanitary risks. The draft legislation incorporates the following key aspects: - Improved alignment of South Africa's current national phytosanitary regulatory system with national and international plant health responsibilities and obligations in the interests of supporting safe and fair trade. - Appropriate phytosanitary export regulation. - Effective national control with regard to the movement of potentially infested plants, plant products and other regulated articles from infested areas to non-infested areas. The envisaged legislation will be supported by revised subordinate legislation such as Regulations, which will be notified through the WTO SPS Committee when drafted.
